Terms of Service

These are the rules for using Folderus, the shared camera for one event. We have kept them as short and plain as we can.

The short version

  • Every feature of Folderus is free. Paid plans only add storage.
  • You own what you upload. You let us store it and show it to the members of the folder, nothing more.
  • You are responsible for what you upload, including photos of other people.
  • One hour after you add a photo to a shared folder, it can be copied into other members' private copies, and those copies are theirs.
  • We cannot recover an encrypted folder. If every member loses its key, the photos are gone.
  • Nothing illegal, nothing abusive. Report problems to support@folderus.com.

1.About these terms

These terms are an agreement between you and LJJKS ApS, a Danish company operating under the brand name Folderus ("Folderus", "we", "us"). They cover the Folderus app for iPhone and Android and the service behind it (together, "the app").

By downloading, installing or using the app, you agree to these terms. If you do not agree, do not use the app. Our Privacy Policy explains what information we collect and how we use it, and forms part of these terms.

2.Who can use Folderus

You must be at least 13 years old, or the minimum age required by law where you live if that is higher. If you are under 18, you may only use the app with the permission of a parent or guardian, who agrees to these terms on your behalf.

3.Your licence to use the app

We give you a limited, personal, non-exclusive, non-transferable and revocable licence to download and use the app on phones you own or control, for your own non-commercial use, in line with these terms and the rules of the store you got it from.

You may not:

  • copy, modify, translate or make derivative works of the app,
  • reverse engineer, decompile or disassemble the app, or try to extract its source code, except where the law expressly allows it,
  • rent, lease, sell, sublicense or redistribute the app,
  • remove or change any ownership notices in the app,
  • use the app to build a competing product or service.

The app, including its design, code and branding, belongs to us and our licensors and is protected by intellectual property laws. These terms do not give you any ownership in the app. All rights not expressly granted are reserved.

4.Guests and accounts

You can use Folderus without an account. The first time you open the app, it creates a guest identity tied to that phone. Guests can join folders, shoot, view and download.

You need an account to keep a private copy of a folder, buy more storage, receive in-app invites, and get your folders back on a new phone. You can create one with your email address, or with Sign in with Apple or Google. When you create an account, everything you did as a guest carries over to it.

If you lose, reset or replace your phone, or delete the app, while you are a guest, you lose access to the folders you joined. Your uploads stay in those folders for the other members.

You are responsible for keeping your sign in details safe and for everything that happens under your account. Tell us straight away at support@folderus.com if you think someone else has used it.

5.Your content

"Your content" means the photos, videos, folder names, display names and anything else you add to the app.

You keep ownership of your content. So that we can run the service, you give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, transmit, process and display your content, and to make previews of it, only as needed to provide the app to you and to the members of the folders you add it to. This licence ends when your content is deleted from our systems, except for copies other members already hold (see Shared folders, private copies and leaving).

You are responsible for what you upload. By adding content, you confirm that:

  • you have the right to add it, and adding it does not break any law or anyone else's rights,
  • the people in your photos and videos are happy for them to be shared with the members of the folder, and you have the consent of a parent or guardian for any child shown where the law requires it.

6.Shared folders, private copies and leaving

Everything you add to a folder, and your display name, can be seen by every member of that folder. Folders are never public. Anyone with a folder's QR code, join code or link can join it until it is full, so share those only with people you want in the folder.

Private copies and the one hour rule

Any member with an account can turn on a private copy of a shared folder. A photo or video is copied into members' private copies one hour after it is added to the folder. If you delete it within that hour, it never reaches anyone's copy.

After that hour, a copy belongs to the member who holds it. Deleting the original, leaving the folder or deleting your account does not remove it from other members' private copies.

Deleting and leaving

  • Only you can delete what you added. Nobody can delete anyone else's photos or videos.
  • Deleted items stay in your trash for 30 days, where you can restore or download them. Then they are permanently deleted.
  • Leaving a folder removes your uploads from it for everyone, and moves them to your trash for 30 days. You cannot leave your photos behind.
  • There is no "delete folder". A folder lasts as long as anyone's photos remain in it, so no single person can remove a shared folder.

7.Readable and encrypted folders

When you make a folder, you choose whether it is readable or encrypted. This choice is fixed when the folder is made and can never be changed.

Readable folders

A readable folder works like a normal cloud folder. Its photos and videos come back on any phone after you sign in to your account.

Encrypted folders

An encrypted folder is end to end encrypted. Photos and videos are encrypted on members' phones, and the keys to open them are held only on those phones. Folderus and our providers hold only scrambled copies of the photos and videos, so we cannot see, recover or restore them. Folder names, display names and basic details about each file, such as when it was taken and its size, are not encrypted. Please read the following carefully before you choose encryption:

  • An encrypted folder only comes back on a new phone if another member's phone hands over the key. Signing out, deleting the app or resetting your phone removes the keys from that phone too.
  • A private encrypted folder, with only you in it, is gone for good if you lose your phone.
  • If every member loses their keys, the folder's photos and videos are permanently lost. This is true on every plan, including paid plans, and we cannot give them back.
  • Joining by link or QR code does not rely on our server: the key travels inside the link and never reaches us. Joining by a typed join code does rely on our server. A code is too short to carry a key, so a member's phone sends the key to the newcomer using the public key our server gives it for them. For that step, you trust our server to introduce the right person.

8.Storage, plans and subscriptions

Every feature works the same for everyone, for free. Storage is the only thing you pay for. There are three plans: Free with 1 GB, Plus with 10 GB and Pro with 100 GB. Downloading to your camera roll is free on every plan.

Storage counts what you hold: your own uploads, plus any private copies you choose to keep. Items in your trash do not count. When your storage is full, uploads and private copies pause until you free up space or change plan. New photos and videos you take wait on your phone in the meantime. Nothing you already hold is deleted because your storage is full.

Paid plans

  • Plus and Pro are monthly subscriptions that renew automatically. There are no free trials. The price is shown in the app before you buy.
  • You buy them through the App Store or Google Play, and payment is charged to your store account when you confirm. Renewal, cancellation and refunds follow the rules of the store you bought from. We never receive your payment card details.
  • To avoid being charged for the next month, cancel before it starts. On the App Store, cancel at least 24 hours before the end of the current period. You can cancel in your store account settings. After you cancel, you keep your plan until the end of the period you have paid for.
  • On Google Play, if a renewal payment fails, you keep your plan for a grace period of up to 7 days while the payment is retried.
  • On Android, moving from Plus to Pro replaces your old subscription, and the time left on it counts toward the new one, so you are never billed for both.
  • If you change phones or reinstall the app, use Restore purchases in the app.
  • Deleting your account does not cancel your subscription. Cancel it in your store account settings.

We may change the storage included in each plan, or plan prices, from time to time. Price changes to an existing subscription are communicated as required by the store you bought it from.

9.Acceptable use

You agree not to use the app to:

  • upload, share or store anything illegal, including child sexual abuse material, which we will report to the authorities,
  • share intimate images of anyone without their consent,
  • harass, threaten, bully or harm anyone,
  • infringe anyone's copyright, trademark, privacy or other rights,
  • upload malware or anything meant to damage or interfere with the app or other people's phones,
  • guess join codes, scrape the service, or get into folders, accounts or data you are not entitled to,
  • get around storage limits, rate limits or other technical restrictions,
  • break any law that applies to you.

10.Reporting content

Anyone can report illegal or abusive content, whether or not they use Folderus, by emailing support@folderus.com. Tell us what the content is, which folder it is in if you know, and why you think it breaks the law or these terms. This address is also our point of contact for authorities.

The founders review every report. We remove illegal content promptly once we know about it, and we may suspend the accounts involved. Folders are never public, so content in Folderus is only ever seen by the members of its folder.

We cannot see inside encrypted folders, so we cannot check what they contain. We can still act on the accounts and folders involved.

11.Suspension, termination and deleting your account

You can stop using the app at any time. You can delete your account in the app under Settings, Delete account, or by emailing support@folderus.com as described on our account deletion page. Deleting your account removes your uploads from every folder and deletes your private copies, except copies other members already hold. Download anything you want to keep first.

We may remove content, and suspend or close accounts, that break these terms or the law. We may also suspend or end your access if we must do so by law, or if we stop offering the app. Where it is reasonable, we will tell you first and give you a chance to download your content.

The sections on your content (for copies other members hold), shared folders, encrypted folders, disclaimers, limitation of liability and governing law continue to apply after these terms end.

12.Apple, Google and other services

The app lets you sign in with Apple or Google, is sold through the App Store and Google Play, and uses other providers to run, as listed in our Privacy Policy. Your use of those services is also subject to their own terms. You must also follow any third party terms that apply when you use the app, such as your mobile carrier's terms for data use.

13.Updates and availability

We may update the app, including automatically, to fix problems or change features. Some updates may be needed to keep using it. We work to keep Folderus available, but it may sometimes be slow, unavailable or interrupted, and we may change or stop features. Keep your own copies of anything important by downloading it to your camera roll. Folderus is a shared camera for events, not a backup service.

14.Disclaimers

To the fullest extent the law allows, the app is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and that the app will be uninterrupted, error free or secure, or that content will never be lost. Some places do not allow some of these exclusions, so some may not apply to you.

15.Limitation of liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, content, profits or goodwill, arising from or related to your use of the app. This includes the loss of content in an encrypted folder whose keys have been lost. Our total liability to you for all claims about the app is limited to the greater of what you paid for Folderus in the 12 months before the claim, or USD 50.

To the extent the law allows, you agree to cover our claims, losses and costs, including reasonable legal fees, that arise from your content or from your breaking these terms or the law.

Nothing in these terms limits liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, or for fraud. If you are a consumer, you keep every right you have under consumer protection laws that cannot be waived by contract.

16.Changes to these terms

We may update these terms as Folderus changes. We will post the new version on this page and update the date at the top. If a change is significant, we will tell you in the app before it takes effect. If you keep using the app after a change takes effect, you accept the updated terms. If you do not agree, stop using the app and delete your account.

17.Governing law and disputes

These terms are governed by the laws of Denmark, without regard to conflict of law principles. Disputes will be handled by the Danish courts. If you are a consumer, this does not take away the protection of the mandatory laws of the country where you live, or your right to bring a claim there.

If any part of these terms is found unenforceable, the rest stays in effect. If we do not enforce a right, that is not a waiver of it. You may not transfer these terms without our consent. We may transfer them to a company that takes over the app. These terms, together with the Privacy Policy, are the whole agreement between you and us about the app.

18.Extra terms for the Apple App Store

If you downloaded the app from the Apple App Store, these terms also apply, and they win over anything in these terms that conflicts with them.

  • Acknowledgement. These terms are between you and us only, not with Apple Inc. ("Apple"). We, not Apple, are solely responsible for the app and its content. These terms do not set usage rules that conflict with the Apple Media Services Terms and Conditions as of the date you accepted them.
  • Scope of licence. Your licence is limited to a non-transferable licence to use the app on any Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the app may be used by other accounts associated with you through Family Sharing or volume purchasing.
  • Maintenance and support. We are solely responsible for any maintenance and support for the app, as described in these terms or as required by law. Apple has no obligation at all to provide maintenance or support for the app.
  • Warranty. We are solely responsible for any product warranties, whether express or implied by law, to the extent they have not been effectively disclaimed. If the app fails to meet any applicable warranty, you may tell Apple, and Apple will refund the purchase price, if any, for the app to you. To the maximum extent the law allows, Apple has no other warranty obligation for the app, and any other claims, losses, liabilities, damages, costs or expenses caused by a failure to meet a warranty are our sole responsibility.
  • Product claims. We, not Apple, are responsible for handling any claims by you or any third party about the app or your possession or use of it, including product liability claims, any claim that the app fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
  • Intellectual property. If a third party claims that the app, or your possession and use of it, infringes their intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling and discharging that claim.
  • Legal compliance. You confirm that you are not located in a country subject to a U.S. Government embargo, or designated by the U.S. Government as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
  • Developer contact. Questions, complaints or claims about the app go to us, at the address in Contact us.
  • Third party terms. You must follow any applicable third party terms when using the app.
  • Third party beneficiary. Apple and Apple's subsidiaries are third party beneficiaries of these terms. Once you accept them, Apple has the right, and is deemed to have accepted the right, to enforce them against you as a third party beneficiary.

19.Extra terms for Google Play

If you downloaded the app from Google Play, these terms are between you and us only, not with Google. Google Play's own terms and policies also apply to your use of Google Play, including to purchases, and Google is not responsible for the app or its content.
